Thank you for choosing to book with The Old Sorting Office. We look forward to welcoming you. By making this Booking you are entering an agreement with us. Please read our terms and conditions of Booking below.

1. Governing terms and conditions

The terms and conditions that apply to your booking depend upon whether you make the Booking with the Agent or the Property Owner.

If the booking is made with the Agent then the Agent’s terms and conditions apply – viewable here, together with clauses 3, 4, 6, 15, 16, 17, 18, 19, 26 and 27 of the terms and conditions outlined on this page.

If the booking is made with the Property Owner then the Property Owner’s terms and conditions as outlined on this page apply in full.

2. Definitions

Additional Fees‘ means any fees payable by the Holidaymaker other than the Rental Charge and Booking Fee.

‘Agent’ means Sykes Cottages (Company Number 4469189) whose registered office is Lime Tree House, Hoole Lane, Chester CH2 3EG.

‘Booking’ means the reservation of the Property by the Holidaymaker.

‘Deposit’ means

  • 50 per cent of the Rental Charge if the Rental Period is due to commence more than six weeks after the date of the Reservation Request; or
  • 100 per cent of the Rental Charge if the Rental Period is due to commence less than six weeks after the date of the Reservation Request.

Holiday Confirmation‘ means the confirmation of the Booking issued by the Agent or Property Owner to the Holidaymaker (by email and/or post) once the Initial Payment has been processed.

‘Holidaymaker’ means the person or the persons making the Booking.

‘Initial Payment’ means the payment of the Booking Fee, the Deposit and any applicable Additional Fees.

‘Property’ means The Old Sorting Office, The Highway, Hawarden, Flintshire CH5 3DG.

‘Property Owner’ means Flintshire Holiday Cottages Ltd (Company Number 9034553) whose registered office is Kentigern, Rectory Lane, Hawarden CH5 3NN.

‘Rental Charge’ means the total rental charge payable with respect to the Booking.

Reservation Period‘ means the period of the rental, usually commencing from 1500 (3pm) on the day of arrival and 1000 (10am) on the day of departure.

‘Reservation Request’ means a request to make a Booking in the form of contact with the Agent  via the Agent’s website, postal address, website or telephone, or the Property Owner via the Booking enquiry form on this site or via other means.

‘You’ and ‘your’ means the Holidaymaker.

3. Included features

The price of the accommodation is inclusive of the following:

  • electricity
  • linen
  • cleaning
  • hot water
  • central heating
  • hot tub
  • Sky TV
  • WiFi

4. Excluded features

The following features are excluded:

  • open fireplaces (non-operational, decorative only)

5. Arrival

Your accommodation will be available to you from 3pm (1500) on the day of arrival, unless otherwise arranged. We may not be able to accommodate you if you arrive earlier than the agreed time as we will be busy preparing the property. Please contact us in advance to check if an early arrival is possible.

6. Late arrival procedure

There is no late arrival cut off time; a key will be provided via a secure unattended key safe. Note that if you fail to take advantage of the accommodation from the commencement of the Rental Period then you will still be charged in full for it.

7. Departure

Please be ready to leave the accommodation by 10am (1000) on the day of departure, unless otherwise arranged in advance. We will provide you with an invoice, payable on departure for any additional services you may have used during your stay.

8. Cancellation and Insurance

By making your Booking, our agreement is a legal contract and your Deposit is non-refundable. If you cannot take your holiday and the Booking cannot be re-let, you are still liable to pay for the Booking in full, even if we have not yet received your balance.

If we do succeed in re-letting the Booking, you are no longer liable for the balance, or we will refund it to you if you have already paid it, less a 10 per cent administration fee.

Please note that your Deposit is not refundable under any circumstances. We would recommend that you take out cancellation insurance to cover this cost.

9. Number of people occupying the Property

You undertake that the number of people occupying the Property will not exceed two during your period of stay.

Unless the express permission of the Property Owner has been granted you will not allow any person other than guests booked and staying in the Property for their holiday to use the facilities and amenities of the Property. Reasonable requests for visits by non-residents will be treated favourably.

10. Purpose of rental

You undertake that the Property will be used solely for the purpose of a holiday by you and your party.

11. Property Owner access

You undertake to allow the Property Owner’s representatives and employees access to the Property, at any reasonable time during the Rental Period.

12. Pets and registered assistance dogs

Sorry, we do not allow pets at this Property. If you arrive with a pet or pets we reserve the right to refuse you access to the Property.  We will hold your Booking for the Reservation Period in order to enable you to make alternate arrangements but your Booking will be forfeit if you cancel.

Without prejudice to this clause, registered assistance dogs are allowed on the Property. You must make us aware of the intended presence of any registered assistance dogs prior to booking. You undertake to keep registered assistance dogs off the furniture and bedding and to compensate the Property Owner for any damage done by your registered assistance dog.

Holidaymakers with allergies should be aware the we cannot guarantee that a registered assistance dog has not stayed on the Property prior to your Reservation Period.

13. Acceptance of children

Sorry, we do not allow children at this property.

14. Smoking

The Property is a non-smoking premises, internally and externally. In the event that smoking is conducted on the premises we reserve the right to terminate your Booking without compensation, charge for a deep cleansing of the property and charge for any damages.

15. Accessibility – bedroom and bathroom access

Note that access to the bedroom and the only bathroom facility is via an open tread spiral staircase. In making this Booking you accept this will not provide cause for cancellation on arrival.

16. Use of the hob tub

A hot tub is provided in the garden. It can be used between 0700 (7am) and 0000 (12am midnight).

Use of the hot tub is at your risk. We undertake to maintain it to a safe and hygienic standard and you undertake to use these facilities in a safe and hygienic fashion.

Please respect the hot tub by ensuring all users

  • shower prior to entry;
  • do not introduce substances of any kind in the hot tub water;
  • do not excessively splash water or undertake water fights;
  • take care if the ground surrounding the hot tub becomes wet and slippery;
  • notify the Property Owner if a breakage of glass occurs in or near the hot tub or anywhere in the Property’s garden;
  • do not enter the hot tub if intoxicated or have a known medical condition for which the use of a hot tub is not recommended;
  • replace the cover when not in use.

The Property Owner reserves the right to withdraw the use of the hot tub without compensation for periods of maintenance during the Rental Period if the hot tub becomes unsafe or unhygienic.

17. Faults

Please  report promptly any faults with the fabric of the building and with the supplied equipment, to include but not limited to

  • lighting
  • heat
  • water
  • electrical supply
  • kitchen and bathroom appliances
  • hot tub

You undertake to mitigate any damage arising from a fault if possible, but will not attempt a repair yourself.

The Property Owner is dependent on external service providers for water, drainage, electricity, Internet and television.

No compensation will be offered if unavoidable technical faults mean that Sky TV and WiFi services  become unavailable during the Reservation Period.

18. Noise, nuisance and respect

The Property nestles within the heart of Hawarden, close to residential property. Our relationship with our neighbours is important to enhance your stay.

You are asked to show due consideration for other parties (to include, but not be limited to, refraining from abuses of the Property and/or dangerous, offensive and rude behaviour to the Property Owner’s representatives and employees and any third parties including but not limited to, neighbours of the Property and residents and business operators of Hawarden).

You will receive one warning if a complaint is received and if this does not result in an acceptable improvement in behaviour and/or noise level the Booking will be cancelled per clause 22 below.

19. Damages, breakages, state of repair and cleanliness

Please take care when staying in our property. You are responsible and liable for any breakages or damages, which you cause, to the accommodation or its contents. All we ask is that you report any incidents as they occur. We do not normally charge for minor breakages, but we will require you to pay for repairs or making good if the damage or breakage is significant, and we may make an additional charge of £10 if you did not report this prior to departure.

You undertake to keep the Property and all furniture and utensils, equipment, fixtures and fittings in  or on the Property in the same state of repair and condition as at the commencement of the Rental Period and to ensure that at the end of the Rental Period  the Property is left in the same state of order and cleanliness in which it was found. The Property Owner reserves the right to levy an additional charge for any extra cleaning required after the Holidaymaker’s occupancy and for any consequential loss;

20. Non-availability of Accommodation

We would only cancel your holiday if your accommodation was unavailable for reasons beyond our control. We would however attempt to offer you alternative accommodation. If this was not possible, or unacceptable to you, then we would refund the Rental Charge. Our liability would not extend beyond this refund.

21. Force Majeure (unexpected events)

No liability can be accepted and no compensation will be paid by the Property Owner or Agent where the Holidaymaker or his personal property (and/or any person in the Holidaymaker’s party and/or their personal property) suffer any loss, damage, injury, disappointment, inconvenience or otherwise, or where the performance or prompt performance of any obligations by the Property Owner or Agent are prevented or affected, by any event which the Property Owner or the Agent could not have reasonably foreseen including war, threat of war, riot, civil strife, industrial action, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, closure of international borders, disease, non-availability of transport services, interruption to services/utilities and all similar events outside of the control of the Property Owner or Agent.

22. Your obligations to us

During the Rental Period you (personally and on behalf of all of the people visiting the Property) undertake (for the benefit of the Property Owner and Agent) to observe in full the governing terms and conditions.

In event of a breach of any of the undertakings set out in these terms  and conditions the Property Owner’s representatives or employees can refuse to allow you to take possession of the Property or make you and your party leave the Property before the end of the Rental Period. In either case you will be deemed to have cancelled the Booking and you will have no claim for compensation or reimbursement whatsoever.

23. Liability

We do not accept any liability for any damage, loss or injury to any member of the Holidaymaker’s party or any vehicles or possessions, unless proven to be caused by a negligent act by ourselves or our employees or contractors whilst acting in the course of employment.

24. Privacy Policy

Any data collected during the course of this booking will be stored on our computer(s). With your permission we may from time to time contact you about promotions and offers. We will not share your details with any third party.

25. Law and Jurisdiction

All contractual obligations arising out of these conditions shall be subject to the laws of England and Wales and the exclusive jurisdiction of the Welsh courts.

26. Complaints

We work really hard to ensure that you have a very enjoyable stay. In the unfortunate event you have a complaint then please let us know at your earliest convenience during the Rental Period, or leave your comments on our feedback form at the end of your stay or failing that contact us via the detail below.

You accept that our ability to resolve your complaint is affected by how soon you tell us about your issue and undertake to inform us at the earliest opportunity of any concern.
